Session on Product Liability Regulation with Jones Day

On May 19, we held the session “New EU Directive on Liability for Defective Products: Practical Implications for Businesses” in collaboration with our partner firm Jones Day.
 
During the session, Antonio Canales, Marta de Cara, and Carla Karch shared with attendees the key aspects of Directive 2024/2853 of the European Parliament and the Council, a highly relevant regulation that redefines the liability framework for damages caused by defective products in the European Union. Topics covered included the expansion of the concept of product, the introduction of new criteria to assess when a product is considered defective, the broadening of responsible parties, the extension of the definition of compensable damage, the easing of the burden of proof for claimants through factual presumptions, and the extension of the limitation period to 25 years in cases of latent personal injuries. All these issues were analyzed from a practical perspective, with a focus on the implications for multinational companies.
